Through space and time...
Emmett Kane is a digital music producer and composer (Who apparently speaks in the third person now) with a focus on combining electronic and orchestral sounds to create a bed of sonic warmth and complex, auditory flavors fit to suit any mood.Inspired by a ruthless desire to not-die-of-exposure-while-also-evading the-creative-minefield-known-as-modern-employment (Okay, now breath), Emmett pursues new and interesting soundscapes meant to inspire and entrap potential artistic partners. (And yes, that is a threat)I'm interested in working on soundtracks for video games, animation, and shortfilms. Pricing
Prices vary, but I generally charge $80 per finished minute.
Terms Of Service
General Terms | • Prices are subject to change based on demand, complexity, and other factors. • I have the right to reject any order for any reason. |
Payment | • The only currency accepted is USD and can be paid through PayPal or bank transfer. • Commissions can be paid either 100% up front or split, 50% up front and 50% after audio sketch approval. • Don’t send any payment until the terms of the commission are agreed upon. |
Process & Delivery | • The time a specific commission takes may vary anywhere between 2 weeks and 3 months, except for rush commissions which are not always available and demand an additional fee. • Once the piece is finished and full payment arrives, a finalized file will be sent in the format(s) of your choosing. There is no physical product exchanged, audio is delivered entirely digitally. • For the purpose of verifying delivery, all communications between the commissioner (you) and the composer (myself), wherein the law permits and which pertains to the commission, will be recorded and preserved. |
Revisions | • Three rounds of revisions are allowed, included in the price of the commission. • A fee will be added for any revisions made to the final piece - unless there was a misunderstanding between the commissioner and myself. • Any changes made to a previously approved step will also constitute an additional charge, which will be determined based on hours worked. • Unclear directions that lead to substantial changes beyond the audio sketch phase will result in additional charges. • Any time a change request will result in an additional fee, you will be warned before the change is made. This warning will include the value of the fee. |
Copyright and usage | I, Emmett Kane: • Reserve the right to cancel and refund the order at any time for any reason. • Retain all copyrights over the commissioned work. • Will NOT claim the intellectual property (IP) of the commissioned artwork. (Any characters, settings, stories, etc…with which it is affiliated remain yours,) • Reserve the right to post the commissioned artwork online, in my portfolio as well as in publications such as articles and collections. You (the customer/commissioner): • May upload the commissioned artwork on any website and social channels with appropriate credit (i.e. linking back to the homepage of this website and/or tagging me on that platform.) • May NOT make profits from the commissioned piece. This includes, but is not limited to: • Reselling • Redistributing • Uploading to streaming services • May NOT alter the commissioned artwork without my (the composer’s) consent. • Retain the rights to the intellectual property (IP) • May NOT use the commissioned audio for commercial purposes. • The following is considered copyright infringement: • Reproducing/using the copyrighted artwork commercially - means making money from it in any way not excluded from these terms. • Claiming the commissioned audio as your own. • Altering the artwork without my (the composer's) consent. • In some cases, the rights to the audio may be purchased. |
Cancellation and Refund Policy | • If the commissioner wishes to cancel the commission for any reason, they may receive a refund only if they pay up front and in full, and only if they agree to pay a kill fee whose amount is determined by the following conditions: • 100% returned before the approval of an audio sketch. • 60% returned after the approval of an audio sketch, but before the approval of a first draft. • No refund after the approval of a first draft. • At this time, the commissioner will receive the work in its current state, with no further allowance for revision. PayPal specific refund policy: • If you are getting a refund, do NOT request a PayPal chargeback. I will transfer the money back to you directly. • If you request a PayPal chargeback at any point, you forfeit all rights herein mentioned to the commissioned work, except those as it relates to intellectual property (IP). The composer will retain all rights herein mentioned to the commissioned work, in addition to the right to post it elsewhere and profit from it. The chargeback will then be contested using previously gathered communication regarding the commission and this agreement. The commissioner will then be blacklisted. |
